Level 3 – Electrical Equipment

All Level 3 in-scope electrical equipment offered for sale must be registered by a Responsible Supplier with the EESS and be marked with the Regulatory Compliance Mark (RCM) in accordance with AS/NZS 4417.1. Only Responsible Suppliers who are registered can sell in-scope Level 2 equipment. Registration of Level 3 equipment will attract a registration fee.

Mandatory registration of Level 3 equipment

To sell in-scope Level 3 equipment in compliance with the EESS, the following is required:

1. The Responsible Supplier is registered in the EESS in-scope electrical equipment safety system register (National Register – also known as the EESS Platform).

1.1 The Responsible Supplier Authorised Officer must provide a declaration that all equipment they are supplying meets relevant standards and is electrically safe (for more information to become a Responsible Supplier see here).

1.2 The Level 3 equipment has a valid and current Certificate of Conformity (to the relevant standards as in force at the time of registration) issued by a recognised certifier and listed in the National Register (EESS Platform).

1.3 The Responsible Supplier registers all Level 3 equipment (or families of equipment) on the National Register (EESS Platform).

1.4 The Responsible Supplier provides an Electrical Equipment Declaration Level 3 which confirms:

i. The Level 3 equipment has a valid and current Certificate of Conformity (to the relevant standards as in force at the time of registration) issued by a recognised certifier and listed in the National Register (EESS Platform).

ii. The equipment meets relevant standards (as in force at the time of registration) and is electrically safe.

iii. The Responsible Supplier making the declaration is the Australian or New Zealand manufacturer or the Australian or New Zealand importer of the equipment.

Note: There is an exemption from registration for plugs, cords and plug/cord/connectors (cord sets) sold as an integral part of other equipment. However, there must be as at the time of sale of the equipment, a current, valid Certificates of Conformity (i.e. not expired, cancelled or suspended, and be to the relevant standards as in force at the time of registration) for that plug, cord, plug/cord/connectors (cord sets) listed on the National Register (EESS Platform).

Choosing registration length

At present, you can select 1, 2 or 5 years of equipment registration length for level 3 equipment.

  • It is expected a Responsible Supplier will obtain a certificate of conformity and will then register the equipment for the full 5 years (certificates have a 5 year expiry date unless expiry dates are restricted due to upcoming changes in safety standards). This is so they have the most certainty of requirements for supply of the equipment.
  • If a Responsible Supplier is using an existing certificate (that has the current relevant standard listed on it) to register the equipment, then the existing certificate may not have a full 5 years before it expires. In this situation the Responsible Supplier may elect to choose a registration period of 1 or 2 years and begin the process of having the certificate renewed or choose to have a new certificate issued. When the renewed or new certificate is issued the Responsible Supplier can then register the equipment for the full 5 years of the new /renewed certificate.

Note: When renewing an equipment registration, the Responsible Supplier can link to a different certificate so long as the models and Trade Names of the registered equipment are on the new certificate.

As an equipment registration length cannot exceed the expiry date of the certificate (as at the time of equipment registration), consideration needs to be given to both the certificate expiry date and the desired length of equipment registration of the level 3 equipment.

Level 3 equipment registration cannot be longer than the expiry date of the certificate being used as at time of registration.

To assist Responsible Suppliers, during the equipment registration process the EESS platform shows you the certificate expiry date and registration expiry date.  The registration expiry date shown is based on years of registration you selected or the certificate expiry date, whichever is shorter. So, if the registration length you choose is longer than the certificate expiry date you will not receive the full registration term you pay for.

For example:

  • If you were registering a level 3 equipment on 1/10/2025, and the certificate was expiring on 5/11/2027, and you choose a registration length of 2 years, then the equipment registration would expire on 1/10/2027 (as the registration length chosen is shorter than the certificate expiry).
  • If you were registering a level 3 equipment on 1/10/2025, and the certificate was expiring on 5/11/2027, and you choose a registration length of 5 years, then the equipment registration would expire on 5/11/2027 (the expiry of the certificate as the registration length chosen is longer that the certificate expiry). In this situation you would forfeit the amount paid for beyond that date and not receive the full 5 years registration you paid.
  • In the situation where the Responsible Supplier wants a longer equipment registration length than the current certificate expiry date, the Responsible Supplier may choose to register for 1 or 2 years and start the process of obtaining up to date test reports (taking into account any upcoming new editions or amendments to the relevant standard) and make application for renewal of the certificate (or make application for a new certificate). When the new/renewed certificate is issued then the Responsible supplier would renew the equipment registration for the 5 years of the new certificate.

As a reminder, these are regulatory fees and not a fee for service. Refunds for incorrect selection of registration length are not available.

3. The Level 3 equipment is marked with the Regulatory Compliance Mark (RCM) in accordance with the requirements listed in AS/NZS 4417.1 & AS/NZS 4417.2. For more information on labelling of items with the RCM click here.

Highly Recommended

Although a Compliance Folder is only mandatory for Level 2 equipment, it is highly recommended the Responsible Supplier maintains a Compliance Folder for Level 3 equipment.

Additional Information

The National Register (EESS Platform) will generate a unique searchable identifier number (Equipment Number) with the following format: first digit the letter “E” followed by a 10 digit number (e.g.: E2025067890) – the first 4 digits after the E being the year of registration, which may assist you in keeping track of equipment registrations.

If the Certificate of Conformity for the Level 3 equipment expires, its registration will also expire as the registration expiry date is set to the certificate expiry date if that is shorter than the period of registration paid for.

  • To continue with a valid equipment registration, you will need to renew the certificate and when that certificate is uploaded onto the National Register (EESS platform) you can renew the equipment registration.
  • Alternately you can obtain a new certificate – with same models and trade names that you have registered – from another certifier and when that certificate is uploaded to the EESS Platform you can renew the equipment registration by linking to that new certificate.

Important Notice

Registration of in-scope Level 2 or 3 electrical equipment as Level 1 is not permitted and could result in penalties.
